Terms and Conditions

1. Agreement to terms
These Terms and Conditions ("Terms") form a binding agreement between you and SimplePages. By accessing or using the SimplePages website, application, or service (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
3. Your account
You are responsible for safeguarding the credentials used to access your account and for all activity that occurs under it. Notify us promptly at support@simplepages.ai if you suspect any unauthorized use of your account.
4. Subscriptions and billing
Paid plans are billed through our payment processor, Stripe. Subscriptions renew automatically at the start of each billing period at the then-current rate unless you cancel before the renewal date. Fees are exclusive of taxes, which you are responsible for paying where applicable.
Except where required by law, fees are non-refundable. Failure to pay when due may result in suspension or termination of your account. You may cancel a paid plan at any time from your account settings; cancellation takes effect at the end of the then-current billing period.
5. License to use the Service
Subject to your compliance with these Terms, SimplePages grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business purposes. You will not:
- copy, modify, or create derivative works of the Service;
- reverse engineer, decompile, or attempt to derive source code;
- resell, sublicense, or otherwise commercialize the Service;
- use the Service to build or train a competing product;
- remove or obscure any proprietary notices.
6. Your content
You retain ownership of the content you submit to the Service, including prompts, drafts, pages, uploaded assets, and brand information ("Your Content"). You grant SimplePages a worldwide, non-exclusive, royalty-free license to host, store, reproduce, technically reformat, display, and otherwise use Your Content solely to operate and provide the Service to you and to the visitors of pages you publish. This license ends when you delete the content or your account, except for limited copies retained in backups for a reasonable period.
You represent that you have all rights necessary to grant this license and that Your Content does not violate applicable law or any third-party right.
7. AI-generated content
The Service uses third-party artificial intelligence models to generate text, images, and code based on your prompts. AI output may be inaccurate, incomplete, biased, or similar to content produced for other users. You are responsible for reviewing AI-generated content before relying on or publishing it, and for ensuring that your use complies with applicable law and third-party rights. SimplePages does not warrant the accuracy, originality, or fitness of any AI-generated output.
8. Acceptable use
You will not use the Service to:
- violate any law or any third-party right;
- publish content that is illegal, defamatory, fraudulent, deceptive, infringing, obscene, hateful, or harassing;
- operate phishing, scams, pyramid schemes, or any deceptive solicitation;
- distribute malware, viruses, or other harmful code;
- send unsolicited bulk communications or facilitate spam;
- publish content that promotes violence, terrorism, child sexual abuse material, or non-consensual intimate imagery;
- attempt to gain unauthorized access to the Service or any related system;
- scrape, harvest, or impose an unreasonable load on the Service;
- circumvent rate limits, billing, or other usage restrictions;
- generate content that violates the policies of the underlying AI providers.
We may investigate suspected violations and may suspend or terminate accounts that violate these rules, with or without notice.
9. Customer-published pages
Pages and websites you build and publish using the Service are your own. You are the publisher of that content and, where applicable, the data controller for any personal information collected through your published pages (for example, through contact forms, lead forms, analytics, and cookies). You are solely responsible for:
- the content of your published pages;
- complying with applicable laws (including advertising, consumer-protection, data-protection, and accessibility laws) in the jurisdictions where your visitors reside;
- providing visitors with any disclosures, consent prompts, privacy policies, cookie banners, and data-subject-request processes required by law, including under GDPR, UK GDPR, CCPA, and CPRA;
- responding to data-subject requests directed at the data you collect.
The Service does not automatically include cookie banners, consent prompts, or privacy notices on your published pages. If you want these on a page, you can ask the editor agent to add them. SimplePages does not advise on, review, or warrant the legal compliance of any page you publish. See our Security & Sub-processors page for more.
10. Copyright and DMCA
If you believe content on a SimplePages-built page infringes your copyright, please send a notice with the elements required by the U.S. Digital Millennium Copyright Act to copyright@simplepages.ai. Accounts of repeat infringers will be terminated.
11. Indemnification
You will defend, indemnify, and hold harmless SimplePages, its affiliates, and its officers, employees, and contractors from and against any third-party claim, demand, loss, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) pages you publish using the Service; (c) your use of the Service; or (d) your violation of these Terms or any applicable law.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. SimplePages does not warrant that the Service will meet your requirements or that any defects will be corrected.
13. Limitation of liability
To the maximum extent permitted by law, SimplePages will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages. SimplePages' total cumulative liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of (a) the total fees you paid SimplePages in the 12 months preceding the event giving rise to the claim or (b) one hundred US dollars (US$100).
14. Term and termination
You may stop using the Service or close your account at any time. SimplePages may suspend or terminate your access for breach of these Terms, for non-payment, or for any other lawful reason on reasonable notice. Sections that by their nature should survive termination, including ownership, indemnification, disclaimers, limitation of liability, and governing law, will survive.
15. Governing law and venue
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms or the Service is the state and federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of those courts.
16. Changes to these Terms
We may modify these Terms from time to time. If a change is material, we will provide at least 30 days' notice (by email or in-app notice) before the change takes effect. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
